    Introduction

    The site is operated by Kesher — Communication Solutions, 14 Chazon Ish St., Apt. 3, Modiin Illit, Israel ("Kesher"). These terms apply to the use of the website, the customer dashboard, the knowledge center and guides, and the problem-report window. Using the site constitutes acceptance of these terms.

    The commercial terms of the service — prices, billing and contract period — are set in the service agreement with the customer. If these terms conflict with the service agreement, the agreement prevails.

    Use of the site is also subject to the privacy policy, which forms part of these terms. These terms apply equally to everyone.

    Definitions

    • "The site" — the websites קשר.ישראל and kesher-phone.com, including the dashboard and the services that run through them.
    • "The dashboard" — the area for signed-in users where the phone system is managed: extensions, queues, menus, dialer, invoices and more.
    • "The customer" — a business or organization that has a Kesher phone system service.
    • "User" — anyone who uses the site, including a customer's employee who was given dashboard access.

    Account and dashboard access

    • Sign-in details are personal. The user is responsible for keeping them safe and not passing them to anyone else.
    • The customer is responsible for the permissions it gives its employees, and for every action taken from its account.
    • Actions in the dashboard affect the live phone system: call routing, queues, campaigns, recordings and balance. Check a change before saving it.
    • If you suspect someone used the account without permission, notify us immediately.

    Permitted and prohibited use

    • The site and the service may be used only in accordance with the law, these terms and the service agreement.
    • It is prohibited to try to bypass security mechanisms or permissions, scan or break into the site without permission, introduce malicious code, or overload the systems.
    • It is prohibited to use the group dialer or messages to send advertising without the recipients' consent, in violation of the Israeli Communications (Telecommunications and Broadcasting) Law, 5742-1982.
    • Call recording is the customer's responsibility: the customer must make sure it is permitted and notify whoever must be notified under the law.
    • Kesher may restrict or block access when there is reasonable suspicion of prohibited use, subject to the law.

    Problem reports and inquiries

    • When you send a problem report, technical information about your browsing is attached, as described in the privacy policy. You can see what is sent before sending.
    • Screenshots may include customer details. The user is responsible for attaching only what is needed, and only what they are allowed to share.
    • A closed report is deleted automatically 12 months after the last activity on it, unless it was locked against deletion. Details are in the privacy policy.
    • Kesher may use reports and requests to improve the service, without publishing identifying details.

    Knowledge center, guides and site content

    The guides and knowledge center provide general information and are not a substitute for professional advice. We try to keep them accurate and up to date, but screens and settings may change.

    Intellectual property

    The rights in the site — design, text, graphics, code and trademarks — belong to Kesher or to whoever permitted Kesher to use them. Content may not be copied, distributed, modified or used commercially without written permission, except as the law allows.

    Availability of the site and the service

    We work to keep the site and the phone system running continuously, but we do not guarantee there will be no interruptions or failures. Maintenance and updates are carried out from time to time and may limit the service for a short while. The structure of the site and its services may change, without detracting from rights under the service agreement.

    Limitation of liability

    • Subject to the law, Kesher is not liable for damage caused by using the site in violation of these terms, or by a setting the user chose.
    • Kesher is not liable for third-party services and infrastructure outside its control, such as internet, telecommunications or filtering providers.
    • The site contains links to other websites. Their content is the responsibility of whoever operates them.
    • Nothing in these terms detracts from any liability or right that cannot be limited under the law.

    Force majeure

    Kesher will not be considered in breach of an obligation because of a delay or failure caused by circumstances beyond its reasonable control, such as war, a state of emergency, a natural disaster, a power or communications outage, a widespread infrastructure failure, or an order of a competent authority.

    General, governing law and jurisdiction

    These terms may be updated from time to time, and the current version is published on this page. These terms and the use of the site are governed solely by the laws of the State of Israel, and jurisdiction lies with the competent courts in Israel.
